What to look for in an AI voice agent.

Conflict-check integration depth.

If your firm uses Clio, MyCase, Lawmatics, or Smokeball, ask the vendor how their conflict check actually works. Live API read against your active matters? Manual import? Webhook lookup with rate limits? The difference matters when a caller mentions an opposing party who is already a client.

ABA Model Rule documentation.

A serious vendor publishes how their script handles Rules 1.6 (confidentiality), 1.7 (conflicts), and 1.18 (prospective clients with no engagement). Ask for the documentation. If they don't have it, you're the unpaid reviewer of their compliance posture.

Latency is the wrong primary metric.

Sub-300ms response time is irrelevant for legal intake. Callers expect a phone call to feel like a phone call. Reasoning quality matters more: whether the agent runs a conflict check before scheduling matters more than whether it answers in 250ms or 900ms.

Privilege and PHI handling.

Intake conversations are prospective-client communications under Rule 1.18 and may contain protected health information for med-mal or PI matters. Ask about encryption at rest, access controls, BAA availability, and whether audio or transcripts are used to train any model.

Pricing structure: per-minute, per-outcome, flat.

Per-minute pricing aligns the vendor's incentive with longer calls. Per-outcome (per qualified intake, per signed retainer) aligns with your incentive but is rare. Flat-rate per-month is simplest. Pick the structure that aligns with how you measure intake.

What happens when the agent doesn't know the answer.

Edge cases are common in legal intake: pro se callers, attorney-shopping, bar-grievance complaints, opposing-counsel inquiries. Ask for a recording of the vendor's agent handling an off-script question. If they can't share one, that's a signal.

Under ABA Rule 1.18, communications with a prospective client are protected even when the firm declines the matter, as long as the conversation is treated confidentially. The AI voice agent's job is to handle the captured communication consistent with that confidentiality: store transcripts as confidential firm records, limit access to authorized users, never use call data to train third-party models, and provide a BAA for healthcare-adjacent matters where PHI is captured.
